ROCK AND WRAP IT UP! CHARITABLE DRAWING BY CHANCE
RULES and REGULATIONS
Rock and Wrap It Up! ('RWIU'), a charity registered pursuant to section 617.1503(1) of the Florida Statutes and a tax exempt organization under section 501(c)(3) of the Internal Revenue Code, is conducting a drawing by chance pursuant to section 849.0935 of the Florida Statutes, to raise funds for its ongoing charitable purposes. RWIU has been actively engaged in feeding the hungry and fighting poverty throughout the United States, including in the State of Florida, for nearly 20 years. The grand prize to be awarded is a $1,000,000 dream home to be purchased anywhere in the United States, at the Winning Entrant's (as defined below) choosing and only in those jurisdictions where it is legal to do so (the 'Grand Prize'). Eight early bird prizes will also be awarded (each an 'Early Bird Prize', and collectively the 'Early Bird Prizes').
The Rules and Regulations (the 'Official Rules') of the RWIU drawing are set forth below. By entering the drawing, all entrants agree to be fully and unconditionally bound by these Official Rules, waive any right to claim ambiguity in the drawing or these Official Rules, and further agree to be bound by RWIU's decision and interpretation of these Official Rules.
1. Eligibility: The drawing is offered and open only to legal residents of the United States and District of Columbia who are 18 years of age or older, or of a majority age under the laws of their resident state at the time of entering the drawing. An affidavit of eligibility, photo identification, taxpayer identification number, and other information will be required from the Winning Entrant. This drawing is void where prohibited. This is not a lottery, this is a drawing by chance. All applicable federal, state, and local laws and regulations apply. RWIU is obligated to report the value of the awarded prizes to tax authorities as income. No mechanically or electronically reproduced entries will be accepted. The following individuals and immediate family members (defined as spouse, IRS dependent, or step- or biological mother, father, sister, brother, daughter or son) of, or who reside in the same household as, any person in any of the following categories, are not eligible to participate: (i) employees of RWIU, (ii) any person engaged in the development, production or distribution of materials or prizes supplied for the drawing, and (iii) any person who resides in any area where the drawing by chance, would otherwise be prohibited by law.
2. How to Enter: The deadline for entry for the Grand Prize drawing is 12:01 a.m. EST on September 1, 2010. The deadline for entry for the Early Bird Prize drawings is set forth in Section 6 below. To enter, a ticket can be obtained by following the instructions on RWIU's website: www.Win4Hunger.org. No purchase, contribution or donation is required to enter the drawing and this drawing is void where prohibited. Entrants must provide a valid e-mail address, full legal name, home phone number, alternate phone number and a physical mailing address. It is suggested that entrants make a minimum donation of $50, to enter the drawing via credit card or electronic funds transfer. Donations are not refundable nor tax deductible. Confirmation will be provided electronically at the time of submitting a entry. RWIU reserves the right to disqualify false entries or entries suspected of being false, and any illegible, defective, incomplete or physically altered entry forms. RWIU is not responsible for printing errors in any drawing-related materials, or for lost, late, misdirected or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of RWIU and will not be returned. Entry deadline dates must be met to ensure entry.
3. Winner Selection: One (1) random drawing for each of the Early Bird Prizes and the Grand Prize from all eligible entries will be conducted by a representative of RWIU. Entrants need not be present to win. All tickets will be verified and selected by a party to be determined by RWIU. All federal, state, and local taxes associated with receipt or use of the prize, including without limitation, all applicable sales, use, luxury, income and special taxes are the sole responsibility of the Winning Entrant. The Winning Entrant need not be present to win. The name of the Winning Entrant, not ticket numbers, will be called. The Winning Entrant will be called by name and verified by matching the ticket with the information in the records and the application form. The Winning Entrant will be notified by telephone, e-mail, or certified mail, return receipt requested; the method to be selected by the Winning Entrant upon entering the drawing. Notification by telephone will be made on the day of the drawing. E-mail or U.S. certified mail, return receipt notification will be made within 48 hours of drawing. To claim the prize, the Winning Entrant must follow the instructions contained in their notification. The Winning Entrant must present proper ID, a valid state-issued driver's license or identification certificate. The Winning Entrant must claim the prize with RWIU and sign and deliver a completed W-9 form, or other form as required by law, to RWIU no later than 4:00 p.m. EST thirty (30) calendar days from the announcement or first attempt to contact, whichever is greater, or the prize will be forfeited and awarded to an alternative winner. The Winning Entrant has one year from claiming the Grand Prize to select a home to be purchased at a location of his or her choosing.
4. Grand Prize Drawing: The actual drawing of the Grand Prize will be held when all tickets have been sold. The drawing is scheduled to be held at Sunrise Sports and Entertainment, One Panther Pkwy, Sunrise, Florida 33323 on or before September 6, 2010 at 4:00 p.m EST. The drawing date may be accelerated as soon as all tickets are sold. The notification of the official drawing date will be posted on RWIU's website: www.Win4Hunger.org. The drawing is open to the public but the Winning Entrant need not be present to win.
5. Grand Prize: The prize to be awarded is a $1,000,000 dream home to be purchased anywhere in the United States (at the Winning Entrant's choosing and only in those jurisdictions where it is legal to do so). In the event that all 300,000 tickets are not distributed by the drawing date, a 50/50 drawing will be held, with the Winning Entrant receiving fifty (50%) percent of the net drawing proceeds and the other fifty (50%) percent being awarded to RWIU, it being understood the total dollar value of the prize awarded in a 50/50 drawing, if such drawing is appropriate, will not exceed $1,000,000. The prize is non-transferable.
6. Early Bird Drawing: Eight (8) random Early Bird drawings will be conducted by a representative of RWIU. The drawing is scheduled to be held at Sunrise Sports and Entertainment, One Panther Pkwy, Sunrise, Florida 33323 on the following dates: (i) all tickets purchased on or before 5:00 p.m. EST on October 12, 2009 will be eligible for the first Early Bird drawing to be held at 5:00 pm EST on October 16, 2009; (ii) all tickets purchased on or before 5:00 p.m. EST on November 12, 2009 will be eligible for the second Early Bird drawing to be held at 5:00 p.m. EST on November 16, 2009; (iii) all tickets purchased on or before 5:00 p.m. EST on December 14, 2009 will be eligible for the third Early Bird drawing to be held at 5:00 pm EST on December 16, 2009; (iv) all ticket purchased on or before 5:00 p.m. EST on January 28, 2010 will be eligible for the fourth Early Bird drawing to be held at 5:00 pm EST on February 1, 2010; (v) all tickets purchased on or before 5:00 p.m. EST on March 1, 2010 will be eligible for the fifth Early Bird drawing to be held at 5:00 pm EST on March 3, 2010; (vi) all tickets purchased on or before 5:00 p.m. EST on April 2, 2010 will be eligible for the sixth Early Bird drawing to be held at 5:00 pm EST on April 5, 2010; (vii) all tickets purchased on or before 5:00 p.m. EST on May 3, 2010 will be eligible for the seventh Early Bird drawing to be held at 5:00 pm EST on May 5, 2010; (viii) all tickets purchased on or before 5:00 p.m. EST on June 1, 2010 will be eligible for the eighth Early Bird drawing to be held at 5:00 pm EST on June 3, 2010. All entrants that were eligible for the Early Bird drawings as described above, including the Winning Entrant, will become eligible for all subsequent Early Bird drawings and the Grand Prize drawing. Should 300,000 tickets be distributed prior to any of the scheduled Early Bird drawing dates, the next and all subsequently scheduled Early Bird drawings will be cancelled.
7. Early Bird Prizes: The Early Bird Prizes to be awarded are as follows: (i) two (2) NY Giant football home game tickets; (ii) two (2) NY Ranger hockey home game tickets; (iii) two (2) NY Yankee game tickets; (iv) two (2) NY Yankee game tickets; (v) two (2) NY Yankee game tickets; (vi) two (2) NY Yankee game tickets; (vii) Corporate Suite (16 seats) at NY Yankee game; (viii) Jones Beach VIP concert package (four (4) tickets).
8. Notification: An Entrant whose ticket number is drawn at the drawing will be deemed the winner of the prize (the 'Winning Entrant'). The Winning Entrant will be notified by phone and/or U.S. mail using the information provided on the Entry Form. If the Winning Entrant cannot be located by 4:00 p.m EST, thirty (30) calendar days after the announcement or (30) days after prize notification, whichever is greater, or if the Winning Entrant is deemed to be ineligible, such Winning Entrant will be deemed to have forfeited his/her prize and another winner will be selected for such a prize. The name of the Winning Entrant may be obtained by visiting www.Win4Hunger.org. The Winning Entrant's name will be posted approximately 48 hours after final drawing. The Winning Entrant assumes all fees, local, state and federal taxes, and transfer taxes and any fees associated with the awarding of the prize. A W-9 form must be completed by the Winning Entrant. No warranties, express or implied, are made or offered by RWIU. The Winning Entrant is advised to consult a tax advisor. The IRS has decided that amounts paid for chances in raffles, lotteries, or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions. Each Winning Entrant must execute an affidavit of eligibility/liability/terms and conditions/publicity release ('Release'). The Winning Entrant must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same entrant named on the winning ticket. Unless restricted by law, each Winning Entrant will be required to complete and return the Release within thirty (30) days of prize notification. The prize may be forfeited if the Winning Entrant: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. In the event the Winning Entrant is found ineligible or forfeits the prize, as described in these Official Rules, an alternate drawing will be held within five (5) business days after verification. If the Winning Entrant is found ineligible, notification of the alternate drawing will be posted on the website, www.Win4Hunger.org, as soon as reasonably practicable and an alternate winner will be selected in a drawing from among all eligible entries received in accordance with these Official Rules.
9. General Terms and Conditions: By entering the drawing, entrants agree to be bound by these Official Rules and the decisions of RWIU which shall be final. The Winning Entrant will be required to execute a Release permitting RWIU to use his or her name, photograph, likeness, and voice for promotional purposes in any media, without compensation, unless prohibited by law. The Winning Entrant will be required to present proof of identity satisfactory to RWIU's sole discretion that matches the name on the winning ticket. Neither RWIU, its employees, founders, owners, investors or any sponsors or any of its subsidiaries, affiliated companies, franchises, services agencies, officers, directors, shareholders, members, representatives or independent contractors or any of its affiliates are responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the Winning Entrant's acceptance or use of the prize. The Winning Entrant agrees to defend, indemnify and hold RWIU and/or its sponsors and each of their respective officers, directors, shareholders, employees, agents and affiliates and identities, harmless from any and all losses, damages, rights, claims, and actions of any kind arising in connection with or as a result of the Winning Entrant's acceptance or use of the prize.
THIS DRAWING IS VOID IN THOSE JURISDICTIONS WHERE IT IS PROHIBITED, INCLUDING, BUT NOT LIMITED TO, ALABAMA, HAWAII, UTAH, SOUTH CAROLINA, CONNECTICUT AND SOUTH DAKOTA.
ALL PERSONAL INFORMATION COLLECTED BY RWIU WILL BE USED FOR ADMINISTRATION OF THE DRAWING. RWIU WILL NOT SHARE, SELL OR OTHERWISE DISTRIBUTE PERSONAL INFORMATION COLLECTED EXCEPT AS SSTATED ABOVE.
